Terms of use

This User Agreement (the Agreement) governs the relationship between ITEM TECHNOLOGY LLP (the Contractor, Operator) and the user of the Taalim mobile application and web service (the User, Service). Registration in the Service, installation of the app and/or use of Taalim functionality means unconditional acceptance by the User of the terms of this Agreement. If you disagree with the terms, do not use the Service.

1. General provisions

1.1. The Taalim Service is software (mobile app for Android and iOS, website) intended for studying the Holy Quran and Arabic: alphabet, reading rules, translations, tafsir, audio and related educational materials.

1.2. The Contractor provides access to the Service under a simple (non-exclusive) license in accordance with this Agreement and applicable law of the Republic of Kazakhstan.

1.3. The Privacy policy posted on the website applies to the Agreement. Use of the Service also means consent to processing of personal data in accordance with the said Policy.

3. Registration and account

3.1. Access to some Service functions may require registration (creating an account). The User must provide accurate data and keep information current.

3.2. The User is responsible for the safety of account credentials and for all actions performed using their account. Upon discovery of unauthorized access, the Contractor must be notified immediately.

3.3. The Contractor may suspend or terminate access to the account in case of the User's breach of the Agreement or applicable law.

4. User rights and obligations

4.1. The User may use the Service for personal non-commercial purposes for learning in accordance with its functionality.

4.2. The User agrees to:

• not use the Service in ways contrary to the law of the RK and this Agreement;
• not decompile, disassemble, bypass technical restrictions, copy and distribute Service materials for commercial purposes without the Contractor's written consent;
• not place through the Service unlawful content, malware, spam;
• respect copyright in texts, translations, audio and other materials available in the Service.

4.3. The Contractor reserves the right to change Service functionality, add or remove sections, introduce paid features, subject to informing Users to a reasonable extent (in the app or on the website).

5. Intellectual property

5.1. Exclusive rights to the Taalim software (app, website, design, structure) belong to the Contractor or lawful rights holders who have granted the respective rights.

5.2. Texts of the Holy Quran, translations, tafsir, audio recordings and other educational materials placed in the Service may belong to third parties and be used under open licenses or by agreement with rights holders. Copying and commercial distribution of such materials without permission of their rights holders is prohibited.

5.3. The name and trademarks of Taalim are the property of the Contractor. Use of the brand by third parties without written consent is prohibited.

6. Limitation of liability

6.1. The Service is provided "as is". The Contractor makes reasonable efforts to ensure stable operation but does not guarantee uninterrupted service and absence of errors.

6.2. The Contractor is not liable for:

• temporary unavailability of the Service for technical reasons or reasons beyond the Contractor's control;
• losses (direct, indirect, lost profit) arising from use or inability to use the Service;
• actions of third parties, including communication and hosting providers;
• content of external sites that may be linked from the Service.

6.3. To the maximum extent permitted by the law of the RK, the Contractor's aggregate liability to the User is limited to the amount actually paid by the User to the Contractor for use of paid features in the last 12 (twelve) months, or zero if paid features were not used.

7. Termination of use

7.1. The User may at any time cease using the Service (uninstall the app, stop visiting the website). To withdraw consent to processing of personal data and delete the account, contact support as per section 9.

7.2. The Contractor may terminate or restrict access to the Service (in whole or in part) in case of material breach of the Agreement by the User or on other legal grounds, with notification where reasonably possible.

8. Applicable law and disputes

8.1. The law of the Republic of Kazakhstan applies to this Agreement and the relationship between the User and the Contractor.

8.2. Disputes are resolved through negotiations. If no agreement is reached, disputes are subject to consideration in court at the Contractor's location in accordance with the procedural law of the RK.

9. Changes and contacts

9.1. The Contractor may unilaterally change the terms of this Agreement. The new version takes effect from the moment of its posting on this page unless otherwise stated in the changes. Continued use of the Service after publication of changes means the User's acceptance of the new version of the Agreement.
